driver qualification file

You may see this in a crash claim letter, a trucking company's document response, or a lawyer's request for records: "Please produce the driver qualification file for the operator." That file is the employer's required record showing whether a commercial driver was properly screened, licensed, medically qualified, and reviewed before being allowed to drive.

For most interstate trucking companies, the file is required by the Federal Motor Carrier Safety Regulations, especially 49 C.F.R. ยง 391.51 (2024). It commonly includes the driver's job application, past employer safety history, motor vehicle record checks, road test or equivalent certificate, medical examiner's certificate, and annual driving record reviews. In plain terms, it is the paper trail showing whether the company hired and kept a safe, legally qualified driver.

That matters after a wreck because the file can reveal red flags: missing licenses, failed medical certification, poor driving history, or ignored prior crashes and violations. In a case involving a semi on I-35 or any other busy Oklahoma route, those records may support a negligence claim against the driver and a negligent hiring, negligent retention, or negligent supervision claim against the company.

If the file is incomplete, altered, or missing key records, that can become evidence in a personal injury claim or wrongful death case. It may also affect settlement value by showing the carrier broke safety rules before the crash ever happened.
