Can I file workers' comp if a driver hit me while I was working in Oklahoma City?

Yes - and the mistake that costs people the most money is assuming workers' comp is your only claim. If you were on the clock when a driver hit you in Oklahoma City, you may have a workers' compensation claim through your employer and a separate third-party injury claim against the at-fault driver.

The next question you should be asking is: Was I truly in the course of work, or was I just commuting?

That matters. If you were driving for deliveries, between job sites, running a work errand, or in a company vehicle, workers' comp is often in play. If you were just driving from home to work, the usual rule is no coverage unless there was a special work-related reason for the trip.

Do these things fast:

  • Tell your employer within 30 days of the crash.
  • Get medical treatment and make sure the visit is tied to the work injury.
  • If the claim is denied, a Form 3 can be filed with the Oklahoma Workers' Compensation Commission in Oklahoma City.
  • Keep the crash report, photos, witness names, and the other driver's insurance information.

If your boss says, "Just use your health insurance," that can be a costly shortcut. A work injury should usually go through the workers' comp system, where approved medical care and disability benefits may be available. In Oklahoma, the employer or insurance carrier usually has major control over the authorized treating doctor in the comp claim.

But the driver who hit you is a different issue. If a distracted parent blew through a school-zone area, or a speeding driver on I-44 caused the wreck while you were working, that outside driver can still be liable. Workers' comp does not erase that claim.

And if the crash happened during flash flooding, do not let anyone brush it off as "just weather." Road conditions matter, but bad driving still matters too.
